Choice of Contract Approach Under The Lens of Cultural Theory

Abstract: We study intercultural differences and attitudes to contract law. We aim to understand to what degree a firm’s choice of its approach to contract law is influenced by cultural considerations. We argue that companies from low context cultures tend to rely on traditional contract practices, while companies from high context cultures on relational contract practices, ceteris paribus. This is an interdisciplinary exploratory study which draws from law, economics, and cultural studies.
